Rental Agreement

Eligibility Conditionals

To rent a game you need to:

  • Have an active membership account, in good standing, with Roll and Rent Board Games Collective having no outstanding fees or balances
  • Be 18 years or older
  • Have an agreed to the Rental Agreement and have a Credit Card Authorization on file with us
  • Available points to spend on the rental of games for the active month
  • Be within the delivery radius

Rental Period

There is no limit to the amount of time that you may keep a Game PROVIDED THAT you maintain an active Subscription which covers the amount of Games in your possession. If you choose not to return one or more Games at the end of your rental period, the number of total points for the Games held by you will be reduced from the number of points that you have earned under your Subscription in the subsequent month.

Points

Our membership plans come with a points system that allows you to rent games from our library. Each month, on the successful purchase or renewal of your membership, you receive a set number of points based on your membership tier.

Unused points from your monthly allocation roll over to the next month. For example, if you have 2 unused points in a month, those 2 points will be added to your next month’s allocation, providing you with a higher total for the following month. You can roll over and hold 2 months’ worth of points (a maximum of double your current membership tier.)

If you decide to keep games you checked out in the previous month into the following month of your membership, the points will be deducted on the 3rd day following your renewal. This will allow you the chance to return the current games

You can check your points by logging into your account.

Game Condition

You agree to return the game in the EXACT condition in which you received it: with all of its pieces, the parts bagged, cards still in sleeves, etc. No alterations or attachments may be made to the game. We’ve included a handy checklist in each game so you can make sure no pieces are missing. We’ll use this list, too, when we inspect the game after its return.

A $2 Reorganization Fee will be charged for games returned in disarray.

If you attempt to return a game that is missing components or is damaged in any way, we reserve the right to charge your credit card for the full MSRP of the game and any expansions and/or extra components inside.

You further agree to keep the game in your care. That is, you will not lend it to someone else. You also agree to refrain from any activities that can affect the condition of the game while playing it, including, but not limited to smoking and/or eating.

Please communicate with us as soon are you know or discover any of the following:

  • If a game is incomplete when you get it (notify us within 24 hours). You may return it and exchange it for another game.
  • When damage or loss occurs to a game while in your guardianship.
Missing, Damaged, or Lost Pieces

It is your responsibility to check that all the parts are present when you receive a game and that all parts are returned in the box when returning the game. To assist with this, we have included a Contents List to make it easier for you to inventory the game.

Shortly after you return a game, we will inspect it to check for missing pieces and damage. If any parts or instructions are missing:

  • We will call or text you and ask you to look for the missing pieces. You will be allowed a 3-day grace period to find and return the missing pieces.
  • If the missing pieces are not found or the game is damaged in any way, we reserve the right to charge your credit card for a partial or full retail price of the game, plus any expansions or extra components contained therein. You will be notified the amount prior to the authorization. The game will then become your property.

Charges

  • Reasonable wear and tear (e.g. crease marks on cards and boards) – No charge
  • Unreasonable wear and tear, such as substantial spills on game components or noticeable tears on cards, resulting in significant impairment of gameplay – Cost of replacement components will be assessed, up to the full value of the damaged game. This includes damages that significantly hinder the usability or functionality of the game beyond what can be reasonably considered as regular wear and tear.
  • A non-vital piece is missing (i.e. the game can still be played without this piece) – $3 charge per non-vital piece up to 3 pieces
  • A vital piece is missing (i.e. game cannot be played without this piece) or more than 3 non-vital pieces are missing – component replacement charge up to full cost of the Game
Damage or Lost Games

It is your responsibility to check that all the parts are present when you receive a game and that all parts are returned in the box when returning the game. To assist with this, we have included a Contents List to make it easier for you to inventory the game.

Credit Card Authorization

You agree to authorize us to keep your credit card on file and give us permission to charge your credit card for:

  • Any fees accrued.
  • Any applicable Reorganization Fees.
  • Game loss or damage.
  • Monthly membership subscription

Safety and Choking Hazard Warning

Games rented from Roll and Rent Board Games Collective are not intended to be used or accessed by children under ten years of age without adult supervision. If you allow any child under the age of ten to play, use or access a game rented from Roll and Rent Board Games Collective, you do so at your own risk. By renting a game, you acknowledge that it may contain pieces, plastic bags, and/or other components that may pose a choking hazard to a child if left unattended. The game’s packaging, inserts and instruction manuals may contain age recommendations and warnings regarding safety which you must heed for your personal safety and the safety of those who may come in contact with the game while it is in your possession. By using this rental service, you accept full responsibility for the safe use of any game rented until it is returned.

Cancellation

You may not cancel the current month’s subscription if any games have been dispatched to you. In this case, you may cancel your Subscription but you will not receive a refund of your payment and your Subscription will expire at the first 30-day cycle once you have returned the Games.

We may end your Subscription at any time by writing to you if you commit a breach of these Terms and Conditions as follows:

  • You do not make any payment to us when it is due and you still do not make payment within 7 days of us reminding you that payment is due;
  • You do not, within a reasonable time, allow us to deliver the Games to you; or
  • You demonstrate a pattern of mistreating or causing damage to our Games.
  • You do not live within the delivery radius

If we end the Contract in the situations, we may deduct or charge you reasonable compensation for the net costs we will incur as a result of you breaching the Contract.

Additional terms

  • The Renter assumes full responsibility for any physical activity engaged in while interacting with item(s) including risks to guests, invitees and self.
  • The Renter voluntarily releases, indemnifies and agrees to hold harmless and discharge Roll and Rent Board Games Collective, from any and all liability, claims, demanded actions or rights of actions, whether personal to itself or to a third party which are related to, arise out of or are in any way connected with the rental of the item(s) described under Game Info including those allegedly attributable to negligent acts or omissions.
  • The Renter agrees to reimburse reasonable attorney’s fees and costs that may be incurred by Roll and Rent Board Games Collective in the defense of any such liability claim, demand, action or cause of action. In the event that the Renter files a cause of action against Roll and Rent Board Games Collective the Renter agrees to do so solely in the state of Texas, and further agrees that the substantive law of that province shall apply in that action without regard to the conflict of law rules of that state.
  • Roll & Rent reserves the right to transfer rights and obligations to another organization.
  • These terms do not give rise to any rights for a third party to enforce any term of the agreement.
  • All content on Roll & Rent’s website, including intellectual property rights, is the sole property of Roll & Rent or licensors.
  • Failure to insist on compliance or exercise rights does not constitute a waiver and doesn’t exempt from obligations.
  • Roll & Rent holds no liability for incomplete, misleading, or deficient information provided by the renter.
  • The Renter agrees if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.
